1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and Postella ("Postella", "we", "us"). By visiting postella.ai, joining the waitlist, or using the Postella app (together, the "Service"), you agree to these Terms and to our Privacy notice. If you do not agree, please do not use the Service.

If you use the Service on behalf of a company or another organization, you confirm that you have authority to accept these Terms for that organization, and "you" means both you and the organization.

2. What Postella is

Postella helps you turn trending topics into social media posts written in your brand's voice. The Service may surface trends, draft content with the help of artificial intelligence, and, where you connect a social account, help you publish or schedule posts to that account.

Postella is currently in a pre-launch phase. Parts of the Service (including the waitlist and any early or founding-member access) are offered as previews and may change, be interrupted, or be discontinued at any time.

Postella uses artificial intelligence to draft posts and suggestions. AI output can be inaccurate, incomplete, outdated, or unsuitable, even when it sounds confident. You agree that:

The Service itself (including its software, design, logo, and the Postella name) belongs to us and our licensors. Except for the limited right to use the Service under these Terms, no rights in the Service are transferred to you. Feedback you choose to send us may be used freely to improve the Service, without obligation to you.

Our Privacy notice explains what we collect, why, who processes it, and how to opt out or ask for deletion. It is part of these Terms.

The Service relies on third parties (for example, email delivery, analytics, bot protection, and the social platforms you connect). Their services are governed by their own terms, and we are not responsible for them. Links to third-party sites are provided for convenience and are not endorsements.

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that drafts will be accurate or effective, or that using the Service will produce any particular audience, engagement, or business result. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

To the fullest extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill; and (b) our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose or 50 US dollars. These limits do not apply to liability that cannot be limited by law, such as liability for willful misconduct.

If you use the Service on behalf of a business, that business will defend and indemnify us against third-party claims arising from Your Content, your published posts, or your breach of these Terms, to the extent permitted by law.

18. Changes to the Service and these Terms

We are building Postella actively, so the Service will change. We may also update these Terms; if a change is material, we will give reasonable notice (for example, by email or a notice on the site) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service.

19. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, except where the consumer-protection law of your home jurisdiction requires otherwise. Before filing a claim, you agree to contact us and give us 30 days to try to resolve the dispute informally.
